DMN8 Privacy Policy

DMN8 (“DMN8,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy describes how DMN8 collects, uses, discloses, and protects personal information when you interact with DMN8’s websites, DMN8-operated digital experiences including the DMN8 experience powered by FitOS, facilities, communications, events, and other services (collectively, the “Services”). DMN8 owns and operates FitOS.
1. Personal Information We Collect
1.1. Information you provide may include name, email address, phone number, mailing or billing address, account credentials, profile information, membership or product preferences, booking information, communications with DMN8, survey or promotion responses, and other information you choose to provide.
1.2. Payment information may include payment-card and billing information. Payment-card details may be collected and processed by DMN8’s payment processor rather than stored directly by DMN8.
1.3. Fitness, safety, or wellness information may include information you voluntarily provide to DMN8 or its trainers or staff when relevant to training, safety, accommodations, or services. DMN8 does not ask you to provide more sensitive health information than is reasonably needed for the applicable purpose.
1.4. Automatically collected information may include IP address, browser and device information, operating system, referral information, pages or screens viewed, interactions with the Services, approximate location derived from technical information, cookie or advertising identifiers, and similar usage information.
1.5. If a DMN8 feature requests device location, camera, notification, or similar device permissions, the information collected depends on the permission you choose to grant and the feature you use.
2. Sources of Personal Information
2.1. We collect personal information directly from you when you create an account, purchase a product, make a reservation, check in, contact us, complete a form, participate in an event or promotion, or otherwise interact with DMN8.
2.2. We collect information automatically through DMN8 websites and digital services using cookies, pixels, SDKs, server logs, and similar technologies.
2.3. We may receive information from service providers and other sources that support DMN8, such as payment processors, communications providers, analytics providers, advertising or social-media platforms, and partners involved in services or promotions.
3. How We Use Personal Information
3.1. We use personal information to provide, administer, and personalize the Services; create and maintain accounts; process purchases and payments; manage memberships, packs, passes, reservations, check-ins, and credits; and provide customer support.
3.2. We use information to send booking confirmations, reminders, billing and renewal notices, account updates, safety or operational notices, and other transactional communications.
3.3. Where permitted, we may use information to send marketing communications, measure campaigns, understand engagement, personalize offers, and support advertising or retargeting. Marketing choices are described below.
3.4. We use information to maintain and improve DMN8 facilities, FitOS, websites, products, services, security, fraud prevention, analytics, and business operations.
3.5. We may use information to comply with law, respond to legal process, enforce agreements and policies, protect rights and safety, resolve disputes, and establish or defend legal claims.
4. How We Disclose Personal Information
4.1. We may disclose personal information to service providers and contractors that perform services for DMN8, such as payment processing, hosting, communications, customer support, analytics, advertising technology, security, and professional services.
4.2. We may disclose information to trainers, employees, contractors, or operational partners when reasonably necessary to provide the service you requested or manage DMN8 operations.
4.3. We may disclose information to government authorities, law enforcement, courts, or other parties when required by law or when reasonably necessary to protect rights, safety, security, or property.
4.4. Personal information may be transferred in connection with a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction, subject to applicable law.
4.5. DMN8 does not sell personal information for money. Certain uses of advertising or analytics technologies may, depending on how they are configured and applicable law, constitute “sharing” or another regulated disclosure for cross-context behavioral advertising. Where applicable, DMN8 will provide the legally required method to opt out of such sharing.
5. Cookies, Analytics & Advertising Technologies
5.1. DMN8 and its service providers may use cookies, pixels, SDKs, local storage, and similar technologies for site functionality, security, analytics, performance measurement, advertising, and retargeting.
5.2. These technologies may collect device identifiers, IP address, browser information, pages viewed, interactions, referral information, and advertising or cookie identifiers.
5.3. You may be able to control cookies through browser or device settings and through any privacy controls DMN8 makes available. Blocking some technologies may affect functionality.
5.4. Where required by applicable law, DMN8 will honor legally recognized opt-out preference signals, such as Global Privacy Control, for the processing to which the signal applies.
5.5. Browser “Do Not Track” signals are not uniformly defined. DMN8 responds to legally recognized preference signals where required and otherwise processes browser controls as described in this Policy.
6. SMS, Email & Other Communications
6.1. DMN8 may send transactional communications relating to accounts, bookings, payments, purchases, safety, facility operations, or other requested services.
6.2. DMN8 sends marketing email or SMS based on the consent or other lawful basis applicable to the communication. Providing contact information for a transaction does not by itself override any consent requirement applicable to marketing.
6.3. You may unsubscribe from marketing email using the unsubscribe link in the message. You may opt out of marketing SMS by replying STOP. For SMS help, reply HELP or contact help@dmn8.com. Message and data rates may apply.
6.4. DMN8 does not sell or disclose your phone number to unaffiliated third parties for their own independent marketing.
7. Data Retention
7.1. We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including providing Services, maintaining business and transaction records, complying with legal obligations, resolving disputes, preventing fraud, and enforcing agreements.
7.2. Retention periods vary based on the type of information, the nature of the relationship, legal requirements, and operational needs. When information is no longer reasonably needed, DMN8 may delete, de-identify, or aggregate it, subject to applicable law.
8. Data Security
8.1. DMN8 uses reasonable administrative, technical, and physical safeguards designed to protect personal information. No security system or method of transmission is completely secure, and DMN8 cannot guarantee absolute security.
8.2. We also expect service providers handling personal information on our behalf to maintain safeguards appropriate to the nature of the information and services they provide.
9. Your Privacy Choices & Rights
9.1. Depending on where you live and the law that applies to DMN8, you may have rights to request access to or information about personal information, request deletion, request correction, opt out of certain sales or sharing, limit certain uses of sensitive personal information, or exercise other privacy rights.
9.2. Where the California Consumer Privacy Act, as amended (“CCPA”), applies, California consumers may have rights to know, access, delete, correct, opt out of sale or sharing, limit certain uses or disclosures of sensitive personal information, and receive non-discriminatory treatment for exercising applicable rights.
9.3. To submit a privacy request, contact DMN8 at help@dmn8.com or use any additional privacy-request method DMN8 identifies on its website. DMN8 may need to verify your identity or authority before completing certain requests. An authorized agent may submit a request where permitted by law.
9.4. DMN8 will not discriminate against you for exercising an applicable privacy right. Some requests may be denied or limited where an exception applies, and DMN8 will respond as required by applicable law.
9.5. If DMN8 engages in activity that constitutes a sale or sharing under applicable California law, DMN8 will provide the required opt-out mechanism, including a “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” link where required.
10. California Notice at Collection
10.1. At or before collection, DMN8 may provide a shorter notice describing the categories of personal information collected and the purposes for which they are used. This Privacy Policy provides additional information about DMN8’s broader privacy practices.
10.2. The categories described in this Policy may include identifiers and contact information; customer records and commercial information; internet or electronic-network activity; approximate location or device information; payment and transaction information; professional or fitness-related information voluntarily provided in connection with services; communications; and inferences or preferences derived from interactions with DMN8.
10.3. DMN8 uses these categories for the business and commercial purposes described in Section 3 and may disclose them to the categories of recipients described in Section 4.
11. Children’s Privacy
11.1. DMN8’s general Services are not directed to children under 13, and DMN8 does not knowingly collect personal information online from children under 13 without appropriate authorization.
11.2. Certain physical services may be offered to minors only when expressly permitted by DMN8 and subject to appropriate parent or guardian involvement and applicable law.
12. Third-Party Links & Services
12.1. DMN8 websites and communications may link to third-party websites, applications, or services. Their privacy practices are governed by their own policies, not this Privacy Policy, unless DMN8 expressly states otherwise.
13. Changes to This Privacy Policy
13.1. DMN8 may update this Privacy Policy to reflect changes in its practices, Services, technology, or legal requirements. The current version and effective date will be posted with the Policy.
13.2. DMN8 will provide additional notice of material changes when required by applicable law. We recommend reviewing the Policy periodically.
